In Massachusetts, if you are operating a motor vehicle with a suspended license, and the reason for that suspended license is an OUI charge, then you are facing mandatory jail time. The judge does not have discretion in such a case- if convicted, you face a mandatory minimum 60 days in jail, up to 2 1/2 years in jail, with a mandatory additional 1 year license loss.
In our experience, it is not uncommon to be improperly charged with this offense. For example, if your license was originally suspended for operating under the influence and simply failed to pay the reinstatement fee; or if your license was suspended due to a breath test refusal and the court-ordered suspension specific to the OUI had not officially started yet, then you may be able to have the charge amended to simple “Operating with a Suspended License“, which does not mandate jail time.
